Common Areas

In order to enhance the overall aesthetics of the community, the Common Area must be kept clear of any clutter, personal items or debris.

The Common Areas consist of the grass and turf areas, landscape beds, driveways, parking spaces, sidewalks, etc.

No clothes, sheets, blankets, laundry or other articles of any kind shall be hung out or exposed on any part of the Common Element Areas.

THOSE IN VIOLATION OF COMMON AREA AND LIMITED COMMON AREA RULES, WILL RECEIVE A NOTICE AND HAVE A PRESCRIBED TIME PERIOD TO REMOVE THE ITEM(S) AND/OR RESTORE THE COMMON ELEMENT AREA BACK TO ITS ORIGINAL STATE. ITEMS NOT REMOVED AND/OR AREAS NOT RESTORED WILL BE REMOVED/RESTORED AT THE OWNERS EXPENSE.

Nothing shall be done or kept in any unit or on the Common Elements which will increase the rate of insurance on the property. In addition, no Owner shall permit anything to be done or kept in his unit or on the Common Elements which will violate any law, statute, ordinance, or regulation of any governmental body or which will result in the cancellation of any insurance maintained by the Association.

No noxious or offensive activities or behaviors shall be carried on in any Unit or on the Common Elements, nor shall anything be done therein either willfully or negligently which may be or become an annoyance or nuisance to other Unit Owners and occupants.

Since the Common Elements include our drive lanes and parking spaces, reckless driving, speeding, racing or excessive noise created by revving engines is strictly prohibited. The speed limit for the Commons at Middletown is 15 mph.

Bicycles/Skate Boards/Other Riding Toys

Skateboards, rollerblades, Mopeds, ATVs and seasonal vehicles such as snowmobiles, as well as any other riding toys, whether electric, gas or battery powered, are not permitted to be used on the lawn areas, sidewalks, drive lanes, parking areas, or anywhere on Common Element areas.

Pedal type bicycles and scooters will be permitted on paved areas when operated in a proper manner, and under the supervision of a responsible person. There will be no reckless operation or racing of bicycles or scooters. They shall not be used on any grassy or hilly areas or in proximity of parked cars. They cannot be used in a manner that would damage the Common Element areas.

In addition, bicycles, scooters and all above mentioned riding toys, lawn furniture, wading pools and firewood are not permitted to be stored on the lawn or planting beds.  Up to two (2) bicycles may be stored on your patio or balcony. See Limited Common area rule below. All other smaller items, such as but not limited to, scooters must be stored in your shed or inside your unit. 

Decorations/Holiday and Garden Ornaments

Lawn ornaments, and other personal items, and decorations are not permitted in the Common Element Areas.  

Decorations and small name signs are not allowed to be attached to Common Element Area siding, gutters or roofs. Doors may be used for display of decorations and small non-illuminated nameplates. 

Inflatable decorations are strictly prohibited.  

Holiday lighting must be confined to your balcony, porch, or patio and neither the lights nor electrical cords shall extend over Common Elements.  Lights must be non-blinking and kept in good order and repair.  Lights that prove to be a nuisance or produce excessive glare are in violation of the Rules and Regulations and must be removed.  No colored lights permitted for any holiday other than the Holiday Season, as mentioned below. (Exception: a single strand of WHITE lights may be hung on your balcony or around your patio posts at any time.) 

Only two holiday items shall be displayed. Either lights and one other item or two items.  Decorations placed inside your unit shall not be visible on the outside. 

(Exceptions: Small battery or electric candles, in windows, are permitted at any time.)  

Holiday season lighting and decorations shall not be displayed before the Thanksgiving holiday.  All lighting and decorations must be removed by January 31 of each year.  Decorations (2 items) celebrating other holidays shall not be displayed more than one week prior and shall be removed no later than one week after the holiday.  

Rules regarding holiday decorations will be strictly enforced.  Holiday décor that is deemed to be excessive will not be permitted and will result in an immediate fine. 

Neither the Association nor a contractor will be held responsible for any damage that occurs to any holiday decoration in furtherance of maintenance, repair and/or replacement of Common Elements and/or Limited Common Elements.  

Wading/Inflatable Pools

Wading pools, whether inflatable or hard plastic, are not permitted to be stored or used on Common Areas.

In addition to interfering with the landscaper’s work, they’re a tripping hazard and contribute to the deterioration of the turf.

Birdfeeders

The display or placement of any kind of wildlife animal feeders including, but not limited to, hanging, stationary, or ground level on the Common Area or Limited Common Areas is strictly prohibited

Note from the Board:  We are allowing one (1) bird feeder (placed in the flower/ground cover beds only) at your own risk. Neither the Association nor a contractor is responsible for any damage that may occur during any contracted work. Please move the birdfeeder out of the way when work is being done to avoid the incurrence of damage.

The Board reserves the right to require the birdfeeder be moved/removed if it becomes a nuisance or health risk to your neighbor, or hinders the ability of the Association or its contractors to conduct maintenance, repair, or replacement work.  If, upon notice, the bird feeder is not removed, the Association reserves the right to move/remove same and assess the cost(s) against the Unit.

Limited Common Areas

 Your patios, porches and balconies must be kept clear of all clutter and debris and in good order, maintenance and repair.

The current rule states that only two (2) items may be placed on your patio, porch or balcony.

Those items may include an outdoor patio table set (table and chairs) and one (1) bicycle OR two (2) bicycles, etc.

The goal is to make sure all patios and balconies look clean, uncluttered and appealing.
